Welcome to 99Server. These Terms of Service ("Terms") govern your access to and use of our website, services, and products ("Services"). By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy.

Important Notice

These Terms constitute a legally binding agreement between you and 99Server. If you do not agree with any part of these Terms, you must not use our Services.

99Server operates under the laws of the State of Delaware, United States. Any disputes will be resolved in the courts of Delaware. For EU customers, specific provisions may apply under GDPR.

Account Terms

Your responsibilities and requirements

To access certain features of our Services, you must create an account with 99Server. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.

Account Security

  • Maintain confidentiality of your account credentials
  • All activities that occur under your account are your responsibility
  • Immediately notify 99Server of any unauthorized use
  • Comply with all applicable laws in your use of the Services
Security Requirement

Accounts registered by "bots" or other automated methods are not permitted. You must be 18 years or older to use our Services.

Age Verification Details

For users under 18, a parent or guardian must create and manage the account. We may request verification of age or parental consent at any time.

Service Usage

Acceptable and prohibited uses

Our Services are designed to provide reliable hosting solutions for legitimate purposes. You agree not to misuse our Services in any way that violates these Terms.

Prohibited Activities

  • Violates any law or regulation
  • Infringes upon the rights of others
  • Is threatening, abusive, or harassing
  • Contains viruses or other harmful code
  • Attempts to gain unauthorized access to systems

Resource Usage Policy

Shared hosting accounts must not exceed:

  • 25% CPU usage for more than 90 seconds
  • 1GB memory usage per process
  • 100,000 inodes per account
  • 100 concurrent connections

Violations may result in temporary suspension or migration requirements.

Payments & Billing

Financial terms and conditions

All Services are billed in advance on a recurring basis (monthly, quarterly, annually) unless otherwise agreed. You authorize 99Server to charge your chosen payment method for all applicable fees.

Billing Policies

  • Non-refundable: Fees are non-refundable except as required by law
  • Late payments: May result in service suspension after 7 days
  • Price changes: Communicated 30 days in advance
  • Chargebacks: Will result in immediate account termination
Financial Terms

Refund Policy

Dedicated server plans come with a 7-day money-back guarantee. Domain registrations, SSL certificates, and setup fees are non-refundable. Refund requests must be submitted within the guarantee period.

Tax Information

All prices are exclusive of taxes. Where applicable, VAT or other taxes will be added to your invoice. EU businesses must provide a valid VAT number for reverse charge.

Service Level Agreement

Our uptime and performance guarantees

99Server guarantees 99.9% network uptime for all Services. If we fail to meet this uptime guarantee, you may be eligible for credits as described below.

Scheduled maintenance and circumstances beyond our reasonable control (force majeure) are excluded from uptime calculations.

Maintenance Windows

Routine maintenance occurs every second Tuesday of the month between 2:00 AM and 4:00 AM UTC. Emergency maintenance may occur with 2 hours notice when possible.

Termination

Ending your service with 99Server

Either party may terminate Services at any time. 99Server reserves the right to suspend or terminate your account immediately for violations of these Terms.

Upon Termination

  • Your right to use the Services will immediately cease
  • All outstanding payments become immediately due
  • You must remove all data from our systems
  • We may delete your data after 30 days
Data Retention
Data Export Options

Before termination, you may export your data through:

  • Web-based control panel exports
  • SSH/SFTP access for direct downloads
  • Request a full backup (additional fees may apply)

Limitation of Liability

Understanding our responsibilities

To the maximum extent permitted by law, 99Server shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

Liability Cap

Our total liability for any claims under these Terms shall not exceed the amount you paid to 99Server during the six (6) months prior to the event giving rise to the liability.

Legal Protection
Force Majeure Events

We are not liable for failures or delays due to circumstances beyond our reasonable control, including:

  • Natural disasters
  • War or civil unrest
  • Internet or utility failures
  • Government actions
  • Third-party service failures

Changes to Terms

How we update our policies

We may modify these Terms at any time. We will notify you of significant changes through email or by posting a notice on our website. Your continued use of our Services after such changes constitutes acceptance of the new Terms.

Notification Process

  • Major changes: 30 days notice via email
  • Minor changes: Posted on our website
  • Emergency changes: Immediate implementation with explanation
Transparency

If you do not agree to the modified Terms, you must discontinue using our Services.
